Tennessee High School Teacher, Sandy Binkley, Convicted Of The Statutory Rape Of Underage Male Students

September 29th 2009

A former Portland High, Tennessee math teacher was convicted of two counts of statutory rape by an authority figure.

The Gallatin jury just returned its verdict.

Sandy Binkley, 37, (pictured left) faced six counts of statutory rape by an authority figure and three counts of sexual battery by an authority figure. The charges involve three alleged victims, two of whom are brothers.

The prosecution and defense each made a final push for their respective sides in closing arguments this morning.

For the prosecution, the focus was on protecting the credibility of the alleged victims while chipping away at Binkley’s testimony.

Binkley accused one of the alleged victims of raping her in March 2008 in a gym office at Portland High school. The alleged victims say it was a consensual encounter.

Binkley claims that the alleged victim forced her to perform two separate sex acts, stripping off some of her clothing and lifting her onto a desk against her will.

“He was a busy man,” said prosecutor Ray Whitley. “He really needed to have a third arm to do all the things she said he did.”

The alleged victim testified last week that the sex in that office was consensual and that their relationship is cherishable even to this day.

Binkley’s attorney, David Ridings, said the the alleged victim’s story wasn’t plausible.

“He wants to look like a victim,” Ridings said. “He’s not a victim.”

Ridings said the other charges against Binkley are based on lies told by the other two alleged victims to cover for the teen Binkley says raped her.

“They want you to think Sandy Binkley is the Portland whore,” Ridings said.

The prosecution further attacked Binkley’s credibility by citing Facebook messages introduced as evidence Monday.

Whitley referenced one post in which she called the alleged victim a “goof,” told him she wasn’t mad at him and told him he owed her one and wanted to know when he would pay up.

“One what?” Whitley asked. “Another rape?”

“It’s a shame that everybody at that school wasn’t made to sit through this trial,” Ridings said. “It’s a shame she’ll never get her name back.”

“I’d say to you we’ve got a school teacher in Portland that likes to live on the edge sexually,” Whitley said.
